Data processed in connection with elections or voting operations may, depending on the technical and contractual arrangements agreed with the organiser of the vote, be processed on infrastructure that is separate from the infrastructure hosting the corporate website.

3. Purpose of the website and services

e-vote.online develops and operates a technical solution for the organisation and conduct of electronic voting, elections and consultations.

The service may include, among other features:

  • configuration of elections and voting procedures;
  • creation or import of electoral rolls;
  • registration and authentication of voters;
  • delivery of practical information relating to the vote;
  • recording of participation;
  • receipt and registration of ballots;
  • vote counting;
  • calculation and publication of results;
  • individual and collective verification;
  • making ballots or verification data available in accordance with the rules applicable to the relevant vote.

The use of e-vote.online in connection with a specific election or vote is subject to the rules established by the organiser and, where applicable, to the relevant statutory, regulatory, contractual, constitutional or internal rules governing that vote.

4. Role of e-vote.online in relation to personal data

For personal data processing activities directly related to the organisation of a vote on behalf of a client, the organiser generally determines the purposes and essential means of the processing.

The organiser therefore generally acts as the data controller within the meaning of the General Data Protection Regulation (“GDPR”).

In such circumstances, e-vote.online processes personal data on the documented instructions of the organiser and generally acts as a data processor, in accordance in particular with Article 28 GDPR.

e-vote.online may also act as a data controller in respect of processing activities for which it determines the purposes and means itself, including processing relating to:

  • operation of the website;
  • contact requests;
  • relationships with clients and prospective clients;
  • contract and customer management;
  • invoicing and accounting;
  • security of its own systems;
  • prevention and detection of misuse and security incidents;
  • compliance with its legal obligations.

The e-vote.online website, its structure, graphic design, texts, software, databases, interfaces, documentation, technical processes and other content are protected by the applicable intellectual property laws.

Any public availability of ballots, verification data or other information in connection with a vote does not grant any intellectual property rights in the software, technology, architecture or other components of e-vote.online.

6. Security and integrity of the system

e-vote.online implements technical and organisational measures appropriate to the risks associated with electronic voting and the processing of personal data.

The platform architecture is based, among other principles, on:

  • separation between voter identification data and ballots;
  • cryptographic mechanisms;
  • access controls;
  • logging of relevant security events;
  • measures intended to protect the integrity and availability of the voting system.

Technical details whose disclosure could weaken the security of the platform may not be published on the website and may instead be disclosed only within an appropriate contractual, audit or supervisory framework.

No information system can guarantee the complete absence of risk.

The specific contractual commitments of e-vote.online concerning availability, security, integrity, business continuity and liability are set out in the applicable agreements and contractual documentation.

7. Information published on the website

e-vote.online takes reasonable care to ensure that the information published on the website is accurate and up to date.

However, information relating to the characteristics, performance or capabilities of the platform must always be assessed in light of:

  • the specific implementation;
  • the nature of the vote;
  • the applicable legal and regulatory framework;
  • the agreed contractual terms.

Any person who becomes aware of a potential vulnerability, security incident or unauthorised access affecting e-vote.online is invited to report it as soon as possible to:
